The www.vialli-design.com Internet shop is an organised part of the company operating under the name Kulig spółka z o.o. in Czechowice-Dziedzice, ul. Pocztowa 14, 43-502 Czechowice-Dziedzice, holding tax identification number NIP 652-171-49-46 and statistical identification number REGON 241847920, entered in the Register of Entrepreneurs of the District Court Katowice-Wschód in Katowice VIII Economic Department of the National Court Register under KRS number 0000376186 and share capital of PLN 1,005,000.00 (hereinafter referred to as the 'Seller'). In addition to the aforementioned mailing address, the Customer may quickly and effectively contact the Seller also via e-mail: sklep@vialli-design.com, or at tel 32 215 23 40. These contact details of the Seller are also appropriate in a possible complaint process.
In order to use the Online Shop, including browsing the range of products in the Online Shop and placing orders, it is necessary to meet the following minimum technical requirements:
- Possession of a computer or other multimedia device with access to the Internet;
- Having a web browser:
- Internet Explorer version 11.0 or later with ActiveX, JavaScript and cookies enabled or
- Mozilla Firefox version 52.0 or later with Java applets, JavaScript and cookies enabled or
- Google Chrome version 56.0 or later with Java applets, JavaScript and cookies enabled or

- Apple Safari 8.0 or later with Java applets, JavaScript and cookies enabled;

- Possession of an active electronic mail (e-mail) account;
- Order
- The customer can purchase goods from the Online Shop's range by filling in an order form. Orders can be placed 24 hours a day, 7 days a week via the Internet Shop's website www.vialli-design.com.
- Order acceptance
- The order is accepted for processing:
- In the case of orders paid on delivery and by bank transfer - after the shop has received the order confirmation,
- In the case of orders paid via the PayU.pl system - upon receipt of confirmation of positive authorisation of payment via the PayU.pl system.
If the Seller does not receive the confirmations referred to in a or b above within 7 days, the Customer is deemed to have cancelled the order, and thus the contract of sale is not concluded. Upon acceptance of the order, the contract of sale is concluded between the Customer and the Seller.
Products
All products offered in the shop are original, brand new and free from both physical and legal defects. Most products are available within 3 working days, with an approximate date of availability shown next to each product. The delivery time is indicated next to each product. This is the time which elapses from the placement of the order until the dispatch of the ordered goods from the shop, excluding public holidays within the meaning of the Act of 18 January 1951 on public holidays (Journal of Laws 1951.4.28. as amended).
Delivery
Przesyłka zawierająca produkt, którą Sprzedawca ma przesłać do miejsca wskazanego przez Klienta będzie niezwłocznie powierzona przewoźnikowi, nie później niż w terminie 30 dni od dnia zawarcia umowy, chyba że umowa stanowi inaczej. Jeżeli produkt nie jest dostępny w magazynie sklepu, termin realizacji zamówienia wydłuża się od kilku do kilkunastu dni roboczych. W przypadku jakichkolwiek opóźnień w realizacji zamówienia Klient będzie informowany o nich i o stanie realizacji zamówienia. W razie opóźnienia Sprzedawcy Klient może wyznaczyć dodatkowy termin do wydania Towaru, a po jego bezskutecznym upływie może od umowy odstąpić. Przesyłka dostarczana jest za pośrednictwem poczty kurierskiej m.in. FedEx Express Polska Sp. z o.o. z siedzibą w Warszawie oraz Paczkomatów InPost.
Przy zamówieniu na kwotę powyżej 149,00 zł opłatę za dostarczenie przesyłki zawierającej produkt ponosi Sprzedawca, natomiast przy zamówieniach do kwoty 149,00 zł opłatę za dostarczenie przesyłki zawierającej produkt ponosi Klient (kupujący). Składając zamówienie Klient każdorazowo zostanie poinformowany o wysokości kosztów transportu i dostawy Towarów, a także konieczności ich poniesienia.
The ordered product can also be collected in person by appointment, directly from the shop, i.e.: 43-502 Czechowice-Dziedzice, 14 Pocztowa St., Monday to Friday from 8:00 am to 4:00 pm.
Combining promotions and discount codes
Unless otherwise stated in the terms and conditions of a particular promotion, promotions, discounts and discount codes are not cumulative. A customer can only take advantage of one promotion, discount or discount code during one transaction. If in doubt, please contact customer service before making a purchase.
The above is in line with the practices of other online shops, where it is often stated that promotions and discount codes do not combine, unless otherwise stated in the terms and conditions of a particular action.
Returns and complaints
The Seller undertakes to deliver the Goods without defects. If, contrary to the above obligation, the delivered Goods contain defects, the Customer may file a complaint.
A complaint may be submitted either electronically or by registered letter sent to the Entrepreneur's address indicated at the beginning of these Terms and Conditions.
The complaint should contain at least: name and surname, e-mail address, Customer, description of the Goods to which the complaint relates and indication of other circumstances justifying the complaint, as well as the Customer's request related to the complaint.
The Seller shall recognise the complaint within 14 days of its receipt by informing the Customer of its position.
The Customer who submits a complaint demanding replacement of the Goods or repair of an identified defect is obliged to deliver at the Seller's expense the defective Goods to the address of Kulig spółka z o.o. ul. Pocztowa 14, 43-502 Czechowice-Dziedzice. The cost of replacement or repair shall be borne by the Seller.
The Seller undertakes to replace the defective item with a defect-free one or to remove the defect within a reasonable time without undue inconvenience for the Customer.
In the event that the Customer's claim for a reduction in the price of the defective Goods is upheld, or in the event of withdrawal from the contract due to a defect in the Goods, reimbursement to the Customer shall be made without delay in a manner analogous to the method of payment for the Goods chosen by the Customer, or in the event of payment on delivery to the bank account or postal order indicated by the Customer.
Konsument ma możliwość skorzystania z pozasądowych sposobów rozpatrywania reklamacji i dochodzenia roszczeń zgodnie z obowiązującymi przepisami prawa. Szczegółowe informacje na temat możliwości skorzystania z pozasądowych sposobów rozwiązywania sporów oraz zasad dostępu do tych procedur dostępne są w siedzibach oraz na stronach internetowych właściwych organów i instytucji, w szczególności miejskich i powiatowych rzeczników konsumentów, Wojewódzkich Inspektoratów Inspekcji Handlowej oraz Urzędu Ochrony Konkurencji i Konsumentów.
Withdrawal from the contract
Klient będący konsumentem ma prawo odstąpić od umowy sprzedaży bez podania przyczyny w terminie 14 dni, zgodnie z ustawą z dnia 30 maja 2014 r. o prawach konsumenta.
Dodatkowo, wychodząc naprzeciw oczekiwaniom Klientów, Sprzedawca dobrowolnie wydłuża termin na odstąpienie od umowy do 30 dni od dnia objęcia Towaru w posiadanie przez Klienta lub wskazaną przez niego osobę trzecią inną niż przewoźnik.
Termin na odstąpienie od umowy wygasa po upływie 30 dni od dnia, w którym Klient wszedł w posiadanie Towaru lub w którym osoba trzecia, inna niż przewoźnik i wskazana przez Klienta, weszła w posiadanie Towaru.
Withdrawal from the contract may apply to all or only some of the Goods covered by the sales contract, with the proviso that if the Goods are sold as a set, kit or bundle, withdrawal is possible with respect to the entire set, kit or bundle, and not with respect to its individual elements.
To exercise the right of withdrawal, the Customer must inform the Seller, i.e. Kulig spółka z o.o. in Czechowice-Dziedzice, ul. Pocztowa 14, 43-502 Czechowice-Dziedzice; e-mail: sklep@vialli-design.com; contact phone: 32 215 23 40 about his/her decision to withdraw from the contract by an unequivocal statement (for example, a letter sent by post, fax or e-mail).

It is not obligatory for the Customer to use the above withdrawal form. The form can be downloaded as a pdf or doc file. The Seller will send the model withdrawal form to the Customer both in paper form together with the purchased goods and in electronic form to the e-mail address provided by the Customer when placing the order, at the moment of confirming the order.
In order to comply with the withdrawal period, it is sufficient for the Customer to send information concerning the exercise of his/her right of withdrawal before the withdrawal period has expired.
In the event of withdrawal from the contract, the contract shall be deemed not to have been concluded. The Seller shall return to the Customer all payments received, including the costs of delivering the Goods (except for additional costs resulting from the method of delivery chosen by the Customer other than the cheapest ordinary method of delivery offered by the Seller), immediately, and in any case no later than 14 days from the day on which the Seller was informed of the Customer's decision to exercise the right of withdrawal. The Seller may withhold reimbursement of payments received from the Customer until the Goods are received back or the Customer provides proof of their return, whichever event occurs first. The Seller shall refund the payment using the same means of payment that were used by the Customer in the original transaction, unless the Customer has expressly agreed otherwise; in any case, the Customer shall not incur any fees in connection with this refund.
The Customer shall send back or hand over the Goods to the Seller immediately and in any case not later than 14 days from the day on which he informed the Seller about the withdrawal from the contract. The deadline is met if the Customer sends back the Goods before the expiry of the 14-day period. The direct costs of returning the Goods shall be borne by the Customer.
The customer shall only be liable for any diminution in the value of the Goods resulting from the use of the Goods in a manner other than that which was necessary to establish the nature, characteristics and functioning of the Goods.
Due to the nature and type of goods offered for sale by the Online Shop, the Customer is not entitled to withdraw from a contract concluded at a distance in relation to contracts in which the subject of performance is an item supplied in sealed packaging which cannot be returned after opening for health protection or hygienic reasons, if the packaging has been opened after delivery.

Quality assurance
All products available in the shop are covered by the manufacturer's guarantee on the terms specified in the guarantee document. A relevant note is placed on the product page and contains basic information necessary to exercise rights under the guarantee, in particular the name and address of the guarantor or its representative in the Republic of Poland, the duration and territorial range of the guarantee protection, the rights to which the customer is entitled in the case of a defect.
In the case of products covered by the guarantee, the Seller issues the guarantee document to the Customer together with the product and checks the conformity of the markings on the product with the data contained in the guarantee document and the condition of seals and other protections placed on the product.
The guarantee does not exclude, limit or suspend the Customer's rights under the warranty regulations for defects of the goods sold.
In order to exercise his/her rights under the guarantee, the Customer shall follow the regulations of these Terms and Conditions concerning Returns and Complaints above, unless otherwise stated in the guarantee document.
Product prices and payment
Each product is marked with a price, which is given in Polish zloty (PLN) and is gross price, i.e. includes value added tax (VAT). The price does not include the costs of transport and delivery of the Goods.
The Seller reserves the right to change prices and add or remove products from the shop's offer, as well as introduce and cancel promotional actions and loyalty programmes. The introduction of the above changes does not affect product sales agreements concluded so far by customers.
The customer can make payment for the purchased products as follows:
- by credit card,
- by bank transfer, via PayU.pl, which collects the payment,
- on receipt of the parcel containing the product,
- by bank transfer, directly to the Seller's bank account.
Data protection
Dane osobowe Klientów są przetwarzane przez Sprzedawcę zgodnie z obowiązującymi przepisami prawa, w szczególności z Rozporządzeniem Parlamentu Europejskiego i Rady (UE) 2016/679 z dnia 27 kwietnia 2016 r. (RODO) oraz ustawą z dnia 10 maja 2018 r. o ochronie danych osobowych.

Final provisions
These terms and conditions are part of the sales contract concluded by the Seller and the Customer. The content of the regulations is binding for the parties according to the wording from the moment of placing the order by the Customer.
The Seller reserves the right to amend these Terms and Conditions for important reasons, such as change of generally applicable law in the Republic of Poland. The amended Terms and Conditions will be effective for orders placed from the date of posting on the Seller's website. Information about the planned change will be placed in a visible place on the website (homepage) of the shop at least 7 days before the change comes into effect. In addition, persons who have registered in the system of the Internet Shop will be notified by e-mail about the planned changes on the same date.
All trade names, product names, company names and their logos used on the www.vialli-design.com shop belong to their respective owners and are used for identification purposes only. They may be registered trademarks. All materials, descriptions and photos presented on the pages of the www.vialli-design.com shop are used for information purposes. The content of the website (texts, images, graphics) and all its fragments are the property of the Seller, manufacturers, suppliers or cooperating entities.
In matters not covered by the Terms and Conditions, the provisions of the Civil Code and the relevant Acts of Polish law, as well as European Union law, in particular RODO (Regulation 2016/679 of the European Parliament and of the Council (EU) of 27 April 2016 on the protection of natural persons in relation to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC) shall apply.
