The www.vialli-design.com Internet shop is an organised part of the company operating under the name Kulig spółka z o.o. in Czechowice-Dziedzice, ul. Pocztowa 14, 43-502 Czechowice-Dziedzice, holding tax identification number NIP 652-171-49-46 and statistical identification number REGON 241847920, entered in the Register of Entrepreneurs of the District Court Katowice-Wschód in Katowice VIII Economic Department of the National Court Register under KRS number 0000376186 and share capital of PLN 1,005,000.00 (hereinafter referred to as the 'Seller'). In addition to the aforementioned mailing address, the Customer may quickly and effectively contact the Seller also via e-mail: sklep@vialli-design.com, or at tel 32 215 23 40. These contact details of the Seller are also appropriate in a possible complaint process.
In order to use the Online Shop, including browsing the range of products in the Online Shop and placing orders, it is necessary to meet the following minimum technical requirements:
- Possession of a computer or other multimedia device with access to the Internet;
- Having a web browser:
- Internet Explorer version 11.0 or later with ActiveX, JavaScript and cookies enabled or
- Mozilla Firefox version 52.0 or later with Java applets, JavaScript and cookies enabled or
- Google Chrome version 56.0 or later with Java applets, JavaScript and cookies enabled or
- Opera version 43.0 or higher with Java applets, JavaScript and cookies enabled or
- Apple Safari 8.0 or later with Java applets, JavaScript and cookies enabled;
- Microsoft Edge version 85.0 or later with Java applets, JavaScript and cookies enabled;
- Possession of an active electronic mail (e-mail) account;
- Order
- The customer can purchase goods from the Online Shop's range by filling in an order form. Orders can be placed 24 hours a day, 7 days a week via the Internet Shop's website www.vialli-design.com.
- Order acceptance
- The order is accepted for processing:
- In the case of orders paid on delivery and by bank transfer - after the shop has received the order confirmation,
- In the case of orders paid via the PayU.pl system - upon receipt of confirmation of positive authorisation of payment via the PayU.pl system.
If the Seller does not receive the confirmations referred to in a or b above within 7 days, the Customer is deemed to have cancelled the order, and thus the contract of sale is not concluded. Upon acceptance of the order, the contract of sale is concluded between the Customer and the Seller.
Products
All products offered in the shop are original, brand new and free from both physical and legal defects. Most products are available within 3 working days, with an approximate date of availability shown next to each product. The delivery time is indicated next to each product. This is the time which elapses from the placement of the order until the dispatch of the ordered goods from the shop, excluding public holidays within the meaning of the Act of 18 January 1951 on public holidays (Journal of Laws 1951.4.28. as amended).
Delivery
The consignment containing the product to be sent by the Seller to the place indicated by the Customer will be immediately entrusted to the carrier, no later than within 30 days of the conclusion of the contract, unless the contract provides otherwise. If the product is not available in the shop's warehouse, the lead time extends from several to several working days. In case of any delays in the fulfilment of the order, the Customer will be informed about them and the status of the order. In the event of the Seller's delay, the Customer may set an additional deadline for the delivery of the Goods, and upon its ineffective expiry, the Customer may withdraw from the contract. The shipment is delivered via a courier service such as FedEx Express Polska Sp. z o.o. with its registered office in Warsaw.
For orders over PLN 300.00, the fee for delivery of the parcel containing the product is borne by the Seller, whereas for orders up to PLN 300.00, the fee for delivery of the parcel containing the product is borne by the Customer (buyer). When placing an order, the Customer will be informed each time about the amount of transport and delivery costs of the Goods, as well as the necessity to bear them.
The ordered product can also be collected in person by appointment, directly from the shop, i.e.: 43-502 Czechowice-Dziedzice, 14 Pocztowa St., Monday to Friday from 8:00 am to 4:00 pm.
Returns and complaints
The Seller undertakes to deliver the Goods without defects. If, contrary to the above obligation, the delivered Goods contain defects, the Customer may file a complaint.
A complaint may be submitted either electronically or by registered letter sent to the Entrepreneur's address indicated at the beginning of these Terms and Conditions.
The complaint should contain at least: name and surname, e-mail address, Customer, description of the Goods to which the complaint relates and indication of other circumstances justifying the complaint, as well as the Customer's request related to the complaint.
The Seller shall recognise the complaint within 14 days of its receipt by informing the Customer of its position.
The Customer who submits a complaint demanding replacement of the Goods or repair of an identified defect is obliged to deliver at the Seller's expense the defective Goods to the address of Kulig spółka z o.o. ul. Pocztowa 14, 43-502 Czechowice-Dziedzice. The cost of replacement or repair shall be borne by the Seller.
The Seller undertakes to replace the defective item with a defect-free one or to remove the defect within a reasonable time without undue inconvenience for the Customer.
In the event that the Customer's claim for a reduction in the price of the defective Goods is upheld, or in the event of withdrawal from the contract due to a defect in the Goods, reimbursement to the Customer shall be made without delay in a manner analogous to the method of payment for the Goods chosen by the Customer, or in the event of payment on delivery to the bank account or postal order indicated by the Customer.
The Consumer may make use of out-of-court complaint and redress procedures. Wishing to make use of the possibility of amicable resolution of disputes concerning online purchases, the Consumer can submit his/her complaint e.g. via the EU online ODR platform, available at: http://ec.europa.eu/consumers/odr/
Withdrawal from the contract
The Customer, in accordance with the Consumer Rights Act of 30 May 2014 (Journal of Laws 2014.827), being a consumer, may withdraw from the concluded sales contract within 14 days without giving any reason. The deadline for withdrawal expires after 14 days from the day on which the Customer took possession of the Goods or on which a third party other than the carrier and indicated by the Customer took possession of the Goods.
Withdrawal from the contract may apply to all or only some of the Goods covered by the sales contract, with the proviso that if the Goods are sold as a set, kit or bundle, withdrawal is possible with respect to the entire set, kit or bundle, and not with respect to its individual elements.
To exercise the right of withdrawal, the Customer must inform the Seller, i.e. Kulig spółka z o.o. in Czechowice-Dziedzice, ul. Pocztowa 14, 43-502 Czechowice-Dziedzice; e-mail: sklep@vialli-design.com; contact phone: 32 215 23 40 about his/her decision to withdraw from the contract by an unequivocal statement (for example, a letter sent by post, fax or e-mail).

It is not obligatory for the Customer to use the above withdrawal form. The form can be downloaded as a pdf or doc file. The Seller will send the model withdrawal form to the Customer both in paper form together with the purchased goods and in electronic form to the e-mail address provided by the Customer when placing the order, at the moment of confirming the order.
In order to comply with the withdrawal period, it is sufficient for the Customer to send information concerning the exercise of his/her right of withdrawal before the withdrawal period has expired.
In the event of withdrawal from the contract, the contract shall be deemed not to have been concluded. The Seller shall return to the Customer all payments received, including the costs of delivering the Goods (except for additional costs resulting from the method of delivery chosen by the Customer other than the cheapest ordinary method of delivery offered by the Seller), immediately, and in any case no later than 14 days from the day on which the Seller was informed of the Customer's decision to exercise the right of withdrawal. The Seller may withhold reimbursement of payments received from the Customer until the Goods are received back or the Customer provides proof of their return, whichever event occurs first. The Seller shall refund the payment using the same means of payment that were used by the Customer in the original transaction, unless the Customer has expressly agreed otherwise; in any case, the Customer shall not incur any fees in connection with this refund.
The Customer shall send back or hand over the Goods to the Seller immediately and in any case not later than 14 days from the day on which he informed the Seller about the withdrawal from the contract. The deadline is met if the Customer sends back the Goods before the expiry of the 14-day period. The direct costs of returning the Goods shall be borne by the Customer.
The customer shall only be liable for any diminution in the value of the Goods resulting from the use of the Goods in a manner other than that which was necessary to establish the nature, characteristics and functioning of the Goods.
Due to the nature and type of goods offered for sale by the Online Shop, the Customer is not entitled to withdraw from a contract concluded at a distance in relation to contracts in which the subject of performance is an item supplied in sealed packaging which cannot be returned after opening for health protection or hygienic reasons, if the packaging has been opened after delivery.
Quality assurance
All products available in the shop are covered by the manufacturer's guarantee on the terms specified in the guarantee document. A relevant note is placed on the product page and contains basic information necessary to exercise rights under the guarantee, in particular the name and address of the guarantor or its representative in the Republic of Poland, the duration and territorial range of the guarantee protection, the rights to which the customer is entitled in the case of a defect.
In the case of products covered by the guarantee, the Seller issues the guarantee document to the Customer together with the product and checks the conformity of the markings on the product with the data contained in the guarantee document and the condition of seals and other protections placed on the product.
The guarantee does not exclude, limit or suspend the Customer's rights under the warranty regulations for defects of the goods sold.
In order to exercise his/her rights under the guarantee, the Customer shall follow the regulations of these Terms and Conditions concerning Returns and Complaints above, unless otherwise stated in the guarantee document.
Product prices and payment
Each product is marked with a price, which is given in Polish zloty (PLN) and is gross price, i.e. includes value added tax (VAT). The price does not include the costs of transport and delivery of the Goods.
The Seller reserves the right to change prices and add or remove products from the shop's offer, as well as introduce and cancel promotional actions and loyalty programmes. The introduction of the above changes does not affect product sales agreements concluded so far by customers.
The customer can make payment for the purchased products as follows:
- by credit card,
- by bank transfer, via PayU.pl, which collects the payment,
- on receipt of the parcel containing the product,
- by bank transfer, directly to the Seller's bank account.
Data protection
Customers' personal data stored in the database of the shop operated by the Seller is processed solely for the needs of the Seller, including the purpose of fulfilling orders placed, and is not and will not be made available to other entities. The data is collected with due diligence and is properly protected against access by unauthorised persons, in accordance with the Personal Data Protection Act of 29 August 1997 (Journal of Laws of 1997 No. 133 item 883). The Customer has the right to access and change his or her personal data, as well as to demand that the Seller cease using it and delete it.

Final provisions
These terms and conditions are part of the sales contract concluded by the Seller and the Customer. The content of the regulations is binding for the parties according to the wording from the moment of placing the order by the Customer.
The Seller reserves the right to amend these Terms and Conditions for important reasons, such as change of generally applicable law in the Republic of Poland. The amended Terms and Conditions will be effective for orders placed from the date of posting on the Seller's website. Information about the planned change will be placed in a visible place on the website (homepage) of the shop at least 7 days before the change comes into effect. In addition, persons who have registered in the system of the Internet Shop will be notified by e-mail about the planned changes on the same date.
All trade names, product names, company names and their logos used on the www.vialli-design.com shop belong to their respective owners and are used for identification purposes only. They may be registered trademarks. All materials, descriptions and photos presented on the pages of the www.vialli-design.com shop are used for information purposes. The content of the website (texts, images, graphics) and all its fragments are the property of the Seller, manufacturers, suppliers or cooperating entities.
In matters not covered by the Terms and Conditions, the provisions of the Civil Code and the relevant Acts of Polish law, as well as European Union law, in particular RODO (Regulation 2016/679 of the European Parliament and of the Council (EU) of 27 April 2016 on the protection of natural persons in relation to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC) shall apply.
